Notes for Rachel COLES

"I Rachel Clark of the township of Rahway in the County of Essex and State of New Jersey being of sound disposing mind and memory; but calling to mind the frailty of my body; and knowing that it is appointed to all mortals once to die, Do make and
publish this my testament and last will in manner following, viz.
First I order my funeral charges to be paid by my executor out of what I bequeath to my daughter in the next item. The remainder of my debts I order my executor to pay out of the general mass of my estate.
Second I give and bequeath to my two daughters, Agnes and Jemima Clark, to them their heirs and assigns Two Hundred dollars in cash, my wearing apparel, and all my household and kitchen furniture of every description. on their paying as above directed,
to be equally divided between them, the money to be paid them within a year after my decease.
Third I give and bequeath to my son Frazee Clark, his heirs and assigns; One Hundred and fifty Dollars to be paid to him within one year after my decease.
Fourth I give and bequeath to my son James Clark One Hundred Dollars, that is the interest, in manner as herein after directed.
Fifth It is my will and I hereby order all my real estate to be sold, as soon as my executor shall think a reasonable price can be obtained therefor, either by public sale or otherwise, not exceeding three years after my decease, and the proceeds of
such sale or sales, and the residue of my estate, after paying my debts as aforesaid, and the legacies above mentioned, shall be equally divided among all my seven children, viz. Job, Ephraim, Dennis C., James, Frazee, Agnes, and Jemima Clark, to them
and their heirs forever, except in the cases of Dennis C. Clark and James Clark as hereinafter provided.
Sixth It is my will and I hereby order, that the share above devised which may fall to my son Dennis C. Clark, if he should die without heirs of his own body, shall be refunded back into my estate, to be equally divided among my children surviving him,
and if any of them should be dead leaving heirs; then his, her, or their heirs to receive their parents share.
Seventh And further, it is my will, that the proportion of my estate which may fall to my son James Clark (after the payment of whatever debt he may owe me at my decease) shall be left in the hands of my executor, to be by him put out at interest on
sufficient surety, and the interest arising therefrom to be paid to him yearly until his death; and after that period the principal to be equally divided among all his surviving children.
Eighth It is my will that all book account, bonds, notes or obligations which I may hold against any or either of my children, at the time of my decease, together with the interest which may be due thereon, shall be taken out of their several shares
herein bequeathed to them. And Lastly, Ihereby nominate, constitute and appoint my beloved son Job Clark, to be executor of this my last wil and testament (hereby revoking all others by me before made).
In testimony whereof, I Rachel Clark, have hereunto assigned my name and affixed my seal, this thirty first day of October in the year of our Lord, one thousand eight hundred and twenty five 1825.

Note in file at WHS - Widow of James Clark(d. 1811); mother of Ephraim Clark et. al. Springfield Road
COLES genealogy file indicates that Dennis Coles was a lawyer [perhaps her brother?]
James Cole [1744-1812] m. Elizabeth Frazee [1746-1826]; among children was Rachel Cole m. James Clark and Dennis Cole [1778-1844].
So....the question is - is it COLE or COLES. Need to examine their wills/documents to see how they signed.

Left a will 30 October 1825 in which she mentioned all seven living children;
Westfield Historical Society has copy of the original in Clark family files.
Will witnessed by Latham Clark, David S. [or L.] Craig, and Dennis Coles.
CC Gardner papers state that she died "at her daughter Agnes Johnson's in
Rahway."
